INDEMNITY/RELEASE/WAIVER

I understand that none of Elementum Coaching Institute (ECI) nor Stefanos Sifandos nor Christine Hassler nor Alexi Panos nor Preston Smiles nor any member of the ECI staff and/or faculty neither collectively nor individually claim to be licensed medical or mental health professionals of any kind. If I am currently under the care of a mental health professional, it is my responsibility to consult with that professional/person regarding the advisability of working with life coaches and/participate in the program(s) offered.  While I may be introduced to some concepts that are used in similar fields (e.g., psychotherapy) I understand this is a coaching/training program and none of the principals or staff of ECI are trained therapists.  

I understand that while a participant of or certified coach as a result of ECI, I cannot and will never present myself as a licensed medical or mental health professional of any kind or will I in any way claim to be. I will ensure any client I work with while participating in or associated with this program understands that if he/she is currently under the care of a mental health professional, it is his/her responsibility to consult with that person regarding the advisability of working with life coaches and to make that person aware of his/her decision to proceed with coaching.  While a participant of or certified coach as a result of the ECI I will never claim or in any way present coaching as a substitute for counseling, psychotherapy, mental health care, or substance abuse treatment.

ECI has the right to refuse service to anyone including without limitation currently enrolled students at our discretion. You agree that your investment with ECI is non-refundable.  I understand that I am expected to uphold the student code of conduct and that I could be asked to terminate participation within the program, if I do not uphold those standards Any refund or partial refund is at the sole discretion of ECI.   

I understand that Elementum is a professional development course for training, NOT a personal development or therapy course. I understand that challenges may come up in the program including but not limited to my own development, personality dynamics with other students or faculty, and personal growth-related issues. I agree to be coachable and receptive to feedback from fellow students, faculty, and master coaches. Signing up for this course means that I will accept responsibility for the professional coursework involved and, if necessary, will reach out for additional support (counseling and/or coaching) outside the program.

I am responsible for seeking independent professional guidance in specialized areas. I understand that all decisions in these areas are exclusively mine and I acknowledge that my decisions and my actions regarding them are my responsibility.  I understand that anything outside of my scope must be referred or reported. Reportable incidents included but are not limited to suicidal ideation, behavior that may put or does put others or self in harm’s way and/or potential mental illness. If you are unsure you are required to consult with a member of the ECI Team.

I agree to indemnify the ECI and/or Stefanos Sifandos and/or Christine Hassler and/or Alexi Panos and/or Preston Smiles and/or any officers, owners, staff/faculty member (collectively the “ECI Team”) from any third party claims based on my breach of the above promises.

By proceeding through this course, I am freely and voluntarily assuming the risks arising from my participation. I take full responsibility for my personal health, mental and emotional health and well-being, my actions and decisions, and my personal care during my time in this program and thereafter.

I understand that I will be required to participate in a trio where I coach other students and am coached by other students for a minimum of one hour per week. I am committed to this work and will show up with vulnerability and compassion. I will treat myself and my fellow students with respect.  I understand the importance of creating a safe space for the client. In order to ensure the integrity of our interactions, I will record all interactions with clients associated with ECI, any of ECI Team or programs and/or ECI students 

I will not slander or demean ECI in any capacity for any reason within any of my internal communication containers within the coaching course or public facing in any way.

The information and processes taught in this program are real and based on years of work with people. However, ECI, cannot guarantee any outcome of a relationship or any other desired outcome by participating in this program. I understand any certification offered is completely at the discretion of ECI that I will have to complete all the curriculum and pass the certification exam with an 80% or better to receive a certification

All products and services by ECI are for educational and informational purposes only. You alone are responsible and accountable for your decisions, actions, and results in life, and by your registration here you agree not to attempt to hold us liable.

BreathWork/Somatic Work

If it so happens that Breathwork or Somatic Work of any kind is part of the service, I acknowledge that I have voluntarily enrolled in this Breathwork/Somatic activity.

I understand that I am under no obligation of any kind to participate in this Breathwork/Somatic Work activity, and I voluntarily enter into this Waiver and Release of Liability.

I understand that Breathwork/Somatic Work is a personal growth experience designed to enhance the quality of life and is not a substitute for psychotherapy.

I understand that this Breathwork/Somatic Work activity will involve strong connected breathing and may include guided meditation.

I understand that Breathwork/Somatic Work can involve dramatic experiences accompanied by strong emotional and physical responses.

I understand that I may find Breathwork/Somatic Work physically, emotionally, and/or mentally stressful. I hereby affirm that I am in good health and able to participate in this activity. I do not have any physical or mental conditions which would impair my ability to engage in this activity or which would otherwise endanger my health during this Breathwork/Somatic Work activity, or which would cause any risk of harm to myself or other participants.

I understand that this Breathwork/Somatic Work activity is not medically supervised. I have hereby been advised that I should talk to my physician and/or psychotherapist if I have any questions about my physical or mental ability to safely participate in this Breathwork/Somatic Work activity. If I have chosen not to obtain a physician’s consent prior to my participation in Breathwork/Somatic Work, I hereby agree that I am doing so solely at my own risk.

I understand that it is my sole responsibility to participate in activities that are appropriate for the current status of my health and to modify this Breathwork/Somatic Work activity to accommodate my own needs or limitations. If I have any questions or concerns about whether or not a particular activity is appropriate to my current health status,

I understand it is my responsibility to ask my doctor before I participate in such an activity. I agree to indemnify and hold harmless ECI from and against any and all claims and expenses, including attorney’s fees, arising out of my participation in this Breathwork/Somatic Work activity.

In consideration of my participation in this Breathwork/Somatic Work activity, I hereby waive and release Stefanos Sifandos and/or Christine Hassler and/or Alexi Panos and/or Preston Smiles, Elementum Coaching Institute, Christine Hassler, Inc. from any and all claims, costs, liability and expense for any injury, loss or damage whether known, anticipated or unanticipated arising from my participation in Breathwork/Somatic Work.

I understand there are certification programs for Breathwork/Somatic work that are required before I can use it in my coaching practice but in all instances, I understand that if I intend to use Breathwork/Somatic work in my coaching practice I will pass on each and every of the above considerations to my clients.  I agree to indemnify Stefanos Sifandos and/or Christine Hassler and/or Alexi Panos and/or Preston Smiles, Elementum Coaching Institute, Christine Hassler, Inc. from my use of Breathwork/Somatic work in my coaching practice or otherwise.  

This Indemnity obligation and Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I acknowledge that I have thoroughly read this Waiver and Release of Liability in its entirety and fully understand it. By agreeing to these terms, I am waiving certain rights I and/or my successors might have to bring legal action or assert a claim against ECI.

Payment Plan Conditions

I acknowledge that if I am on a payment plan and I miss a month, I will be granted a 30 day grace extension period with a one-time and final warning, where in this time I can continue to participate in Elementum. If that missed payment is not made within 30 days, along with any next applicable payments, then I recognize I will be restricted access from all aspects of the program irrespective of where I am in my payment plans and in the program. After access is restricted, I acknowledge that I will have 15 more days to arise with any and all missed payments and if this is successful, I will be allowed full participation into the program.

Video Audio Photography Release

I hereby consent to be photographed, recorded, and/or filmed by ECI the following terms:

1. ECI will own any and all rights in the photography, recording, or filming for the purposes of the ECI training and marketing (the “Use”). Recordings of live coaching sessions will only be seen internally or by other ECI students who have enrolled in the course and will not be utilized for social media, marketing, or any other public purposes. I acknowledge and agree that these limitations do not apply to a testimonial I provide.
2. I consent to the Use of any printed material in conjunction with the abovementioned Use.
3. I hereby waive all personal rights and objections to, including the right to inspect, any Use which will be made of my Appearance by ECI.  “Appearance” as used herein means my name, image, physical likeness, voice, any and all attributes of my personality and/or performance;
4. I hereby waive, release and forever discharge the ECI and all persons acting under its permission or authority from all claims, actions, and liability relating to Use.
5. I understand that I will not receive any payment or any form of remuneration now or in the future in consideration for the above consent.
